Agreement Overview
These terms apply to SapphireXR at sapphirexr.com: its website, the browser viewer (on computers, phones, tablets and VR headsets), accounts, worlds, avatars, events, the store and every other feature of this platform. SapphireXR is run by its platform operator, Freelight Labs, ("we", "us"). By creating an account or using SapphireXR you agree to these terms and to our community rules. If you do not agree, do not use SapphireXR.
SapphireXR runs on technology and servers provided by InHouseXR. By using SapphireXR you also agree to follow the InHouseXR Terms of Service. Where the two differ, the stricter rule applies. InHouseXR is not the operator of this community and does not moderate it day to day, but it can act on its own when its terms are broken (see Suspensions And Bans).
Community Rules
Every community is different, so the people who run SapphireXR set its rules. The basics below always apply; the platform operator may add its own rules here or on a separate page, and they are part of these terms.
- Be respectful. No harassment, threats, hate, bullying, stalking, doxxing or impersonation.
- Keep content and behaviour suitable for the spaces you are in. Adult content only where the operator allows it, and only for adults.
- No spam, scams, cheating, exploits or disrupting worlds and events.
- Only upload and share things you have the right to use.
- Follow the instructions of the platform's administrators and moderators.
Terms Of Service
1. Accounts
You need an account for most features. Give accurate information, keep your password private and tell us straight away if someone else uses your account. You are responsible for everything done with your account. One person may not use another person's account.
2. Age
You must be at least 13 years old to use SapphireXR, or older where the law where you live requires it. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you. Spaces and content marked for adults are only for people aged 18 or over (or the age of majority where you live, if higher).
3. Using The Service
SapphireXR runs in your web browser; there is nothing to install. We give you a personal, revocable, non-transferable permission to use it under these terms. You may not copy or resell the service, get around its security or limits, scrape private data, overload it, or use it for anything unlawful.
4. Changes
Features, worlds, prices, limits and these terms may change over time. When the terms change, the date at the top changes; continuing to use SapphireXR afterwards means you accept the new version.
5. No Warranty
SapphireXR is provided "as is" and "as available". We work to keep it running and your data safe, but we cannot promise it will always be available, error-free or that content will never be lost. Keep your own copies of anything important.
6. Limitation Of Liability
To the extent the law allows, Freelight Labs and InHouseXR are not liable for indirect or consequential losses, lost profits, lost data or content, or interruptions of the service. Nothing in these terms limits liability that cannot be limited by law.
Your Content
7. You Own Your Content
Worlds, avatars, items, pictures, media, scripts, text and other things you upload or create stay yours. You give Freelight Labs and InHouseXR the permission needed to store, copy, process and show them so the service works (for example, showing your world to its visitors, making thumbnails and backups), according to the visibility settings you choose.
8. Your Responsibility
You are responsible for what you upload and share. You confirm that you have the rights to it, including music, video, logos, likenesses and other people's work. Illegal, infringing, sexually exploitative, hateful or harmful content is not allowed.
9. Removal
Content that breaks these terms, the community rules, the InHouseXR Terms of Service or the law may be removed, hidden or restricted without notice. To report content that infringes your rights, contact the platform's administrators (see Contact).
Purchases And Events
10. Who Handles Payments
Money paid on SapphireXR (Pro memberships and coin packs) is charged by InHouseXR through Stripe, a secure payment provider, under its own terms. Card details are never stored on SapphireXR. Receipts and card changes are handled on Stripe's secure pages.
11. Pro Membership
Pro is a monthly membership with extra storage and features. It renews every month until you cancel it on your account page; it then stays active until the end of the month already paid. Pro can also be given as a gift code, which runs for the time shown on the code and then ends by itself. Prices may change; a change applies from your next renewal and is shown before you pay.
12. Coins
Coins are bought in packs and spent inside SapphireXR on event tickets and store items. Coins and the items bought with them are a licence to use content inside SapphireXR: they have no cash value, cannot be exchanged for money (except through the creator cashout below) and cannot be transferred between accounts. Balances that are wrong because of an error, fraud or abuse may be corrected.
13. Selling And Cashing Out
Creators can sell items in the store and hosts can sell event tickets for coins. Creators can ask to cash out the coins they earned: the request is checked and, when approved, paid by PayPal after the fees shown on the cashout page, by InHouseXR. Requests may be refused or delayed, and coins may be taken back, when they come from fraud, chargebacks or broken rules.
14. Events
Anyone allowed to host events is responsible for their event and for what they promise in it. Tickets are paid in coins through SapphireXR's own ticketing; tickets for events on SapphireXR may not be sold elsewhere unless the operator allows it. If an event is cancelled, the host or the operator decides whether coins are refunded.
15. Refunds And Chargebacks
Payments already made are generally not refunded, except where the law requires it or the operator decides otherwise in a particular case. Please contact the platform's administrators before disputing a charge with your bank; a chargeback may lead to the purchases and coins connected to it being removed and to account restrictions.
Suspensions And Bans
16. By The Platform Operator
Freelight Labs and the administrators and moderators of SapphireXR may warn, mute, remove from a world, suspend or ban any account, and remove any content, when they believe these terms or the community rules have been broken, to protect other users, or when the law requires it. We try to be fair and to explain decisions, but we are not required to.
17. By InHouseXR
Because SapphireXR is hosted by InHouseXR, InHouseXR may also, on its own, suspend or remove any account or content on SapphireXR, or the whole platform, when its Terms of Service are broken: for example illegal content, content that exploits minors, fraud, spam, malware, attacks on the service or other users, or when the law or a payment provider requires it. Such decisions are made by InHouseXR; the platform operator may not be able to reverse them.
18. What Happens Then
A suspended or banned account cannot sign in or use purchases, and may lose content, coins and items connected to it. Trying to get around a ban (for example with a new account) is not allowed.
Privacy Policy
What We Collect
Information you give us: username, email address, password (stored securely), profile, the content you upload, messages and support requests. Information collected while you use SapphireXR: IP address, browser and device details, log and security records, and what you do in worlds and events (for example which world you are in). Voice chat is sent live to the people near you.
How We Use It
To run your account and the service, keep it secure, stop abuse, enforce these terms, provide support, process purchases and meet legal obligations. We do not sell personal information.
Who Can See It
Your username, profile, avatar and public worlds, events and items are visible to other users. Personal information is shared only with the service providers that run SapphireXR (including InHouseXR, which hosts it), the payment provider for purchases, and authorities when the law requires it.
Cookies
We use cookies and browser storage to keep you signed in, remember your settings and keep the service secure. Blocking them may stop parts of SapphireXR from working.
Keeping And Deleting
We keep information while your account exists and for as long as needed for security, disputes and the law. You can ask the platform's administrators for a copy of your information or for your account to be deleted; some records (such as purchase records) must be kept for a time.
Children
SapphireXR is not for children under 13. If we learn that a child under 13 has an account, we will delete it.
